The Legal Protection of the Trademark: (A Comparative Study) between Libyan and Egyptian Law

Abstract

Trademarks are considered among the most prominent industrial property rights, as they play a pivotal role in distinguishing products and services through their direct relationship with the public via the purchase of goods and the receipt of services. The present study aims to provide a comprehensive overview of the legal regulation of trademarks under Libyan and Egyptian law, shedding light on the concept and legal nature of trademarks, in addition to analyzing the legal framework for their protection as established in the legislations of both countries. The study adopts a comparative approach to explore the similarities and differences between the relevant laws, considering trademarks as an element of intellectual property that distinguishes products and services. It also analyzes the procedures related to trademark registration and their protection against infringement or imitation in both the Libyan and Egyptian systems. The study revealed a significant similarity in the legal framework for trademark protection between the two legal systems, with some minor differences in the procedures and requirements for registration and protection. It also concluded that there is a need to develop certain legislative aspects to keep pace with modern developments in global commerce and to protect trademarks in cyberspace .
