Abstract
The study titled "guarantees of a fair trial for the defendant during the investigation phase before the international criminal court" examines the procedural and substantive safeguards provided by the Rome statute. lt aims to evaluate the effectiveness of these guarantees amidst challenges such as political interference by the un security council and the consolidation of investigative and prosecutorial powers in the hands and prosecutorial powers in the research underscores the significance of the investigation phase as the cornerstone for gathering evidence and building cases, highlighting key safeguards like independence, confidentiality, and procedural speed . The study concludes that the court faces major challenges, including political interventions and the prosecutor's broad discretionary powers, alongside the absence of effective appeal mechanisms lt proposes enlacing the court's independence by separating investigative and prosecutorial functions, clarifying the concept of ''interests of justice'' establishing effective appeal mechanisms to support the court's operations .
