Methodological Rules for Organizing Evidence and Methods of Reasoning in Comparative Jurisprudence Research

Abstract

This is a concise study titled "Methodology of Writing Fiqh Research", aiming to explore the methodological foundations necessary for producing scholarly works in Islamic jurisprudence. It highlights the essential features of fiqh research and outlines what a researcher must master before embarking on such a task. The research problem revolves around the methodological principles of writing juristic research, including general writing standards, proper citation practices, and the organization of shar‘i evidence. The study is divided into four main sections: General guidelines for writing fiqh research. Methodological standards for handling quotations. Approaches to presenting and weighing legal evidences. Authoritative references in the four Sunni schools of jurisprudence. The study concludes with several key findings, most notably that juristic research is not based on mere personal reasoning. Rather, it is a disciplined scientific endeavor grounded in the principles of usul al-fiqh and rigorous inferential methods. It emphasizes that contemporary researchers must be equipped with scholarly tools that combine classical jurisprudential depth with a keen awareness of modern realities. This combination is essential for producing relevant legal judgments that address current needs without compromising the traditional methods of deduction used by Islamic scholars throughout the centuries. Among the recommendations is the need to give greater attention to teaching research methodologies in fiqh and comparative jurisprudence within university curricula. The study also stresses the importance of practical training, structured application, and the integration of modern digital tools— such as electronic software and online encyclopedias—to enhance research efficiency and accuracy
