Extrapolation of the Sayings of the Imam Malik in Maliki School

Abstract

This research dealt with an important issue of fundamental issues, which is the issue of extrapolation of the sayings of the Imam Malik, which is one of the tools of the jurists of the madhhabs in explaining the ruling of Nawazel, which is a precise scientific path that requires an understanding of the Imam's intent, and a control of the rules of his doctrine, in order for the jurist to extract a ruling on a matter in which there is no text about the Imam through his statements and his principles in similar issues. The researcher aimed through him to highlight the status of jurisprudential graduations as one of the restricted ijtihad tools in the Maliki school and its role in addressing contemporary issues, according to the origins of the doctrine, and to answer questions; how to practice jurisprudence What are the methodological controls that should be observed in this process? to conclude after that that Takhrij (extrapolation) on the sayings of Imam Malik is a restricted ijtihad that strengthens the solidity of the doctrine and allows the extrapolation of the rulings of new issues in the light of its principles, without departing from its texts or contradicting them, indicating that the takhrij jurist has conditions that qualify him to be qualified for this great work, and the five methods and controls of takhrij were integrated to form a precise methodological framework that protected the original text and expanded the horizons of jurisprudential application.
