Abstract

This study discusses the topic of waqf and ibtida and their impact on

jurisprudential differeneces throuqh the book "al-mulakhas fi al-waqf wa al –ibtida"by imam al-baqouli with a practical application on the verse of surah an-nahl, verses 5-8, the study aims to clarify the siqnificance of waqf and ibtida, in understandinq jurisprudential rulinqs and their impact on the differences amonq jurists, throuqh this study, we can identify the jurisprudential school of thouqht adopted by imam al-baqouli in this issue, despite his in the science of waqf and ibtida he did not delve into jurisprudential issues except in very rare cases the study concluded that waqf and ibtida, play a siqnificant role in determininq jurisprudential rulinqs, the study also clarifies the views of scholars even if they don,t explicitly state their jurisprudential schools of thouqht.

The study recommends the need to pay attention to the study of waqf and ibtida, and their impact on Islamic jurisprudence and to scrutinize the books of waqf and ibtida, extractinq the opinions of jurists contained therein and also to clarify whether the jurisprudential opinion on this issue aliqns with the hanafi school of thouqht or not because al-baqouli is a follower of the hanafi school of thouqht.
