Abstract
This study examines the issue of deck cargo in light of technological advancement and traditional legal rules in the field of maritime transport, given the growing importance of deck cargo and the significant technological development in this area, which has contributed to the expansion and growth of maritime trade. However, this rapid technological progress has been accompanied by a legislative gap in some countries, as traditional legal frameworks have failed to keep pace with technological developments due to the slow process of drafting and updating laws compared to the speed of technological change.
This research aims to highlight the risks associated with the carriage of goods on deck and to examine the various legal solutions adopted by maritime legislations in some countries to regulate deck cargo. It also reviews relevant international conventions governing this subject and analyzes the extent to which current legal rules are adequate in achieving a balance between technological advancement and the protection of the parties to the maritime transport contract.
