Misyar and Urfi Marriages and Their Ruling in Islamic Law

Abstract
This research examines Misyar and Urfi marriages and their legal status in Islamic law. Misyar and Urfi marriages are considered non-traditional forms of marriage in Muslim societies. Misyar marriage is conducted with a legally valid contract, but the wife may waive some of her rights, such as housing and maintenance. It is considered permissible under certain circumstances, although there are social and legal reservations regarding its consequences. Urfi marriage, on the other hand, is a contract that is not officially documented. It may be valid if it meets the legal requirements, such as the presence of a guardian and witnesses, but it is invalid if it is conducted secretly or without a guardian. Both types of marriage raise jurisprudential and social debates due to the potential loss of rights or family disintegration that may result. Therefore, documentation is recommended to guarantee the legal rights of both parties.
