Custom and its contemporary applications in branches of Maliki jurisprudence
Main Article Content
Abstract
Custom is one of the sources of Islamic legal rulings that ensures the flexibility and suitability of Islamic law for all times and places, especially among Maliki scholars. They consider custom to be evidence for Islamic legal rulings, restricting the absolute with it, and specifying the general from the legal texts with it. Custom, in their view, is the basis for the branches of jurisprudence in all chapters of jurisprudence, both in the past and in the modern era, and they built upon it the fundamental and jurisprudential rules.
