Revocation in Maliki Jurisprudence and Its Impact on Family Stability

Abstract
This research examines the provisions of "Al-Raj'ah (Revocable Return) in Maliki Jurisprudence and its Impact on Family Stability." It aims to clarify the concept, conditions, and forms of Raj'ah according to Maliki scholars, while exploring its maqasid (objectives) and social dimensions. The study employs an analytical historical approach to extract jurisprudential material from primary Maliki sources and apply it to contemporary family dynamics. The research concludes that the legislation of Raj'ah serves as a preventive, reformative license that preserves the family structure from hasty decisions made in anger. Furthermore, it highlights the distinctiveness of the Maliki school in requiring intent (Niyyah) for physical return to ensure seriousness and protect women's rights. The study recommends enforcing the legal documentation of Raj'ah in family courts.
