Restorative criminal justice in Libyan criminal legislation:brtween shortcoming and development requirement

Abstract

Restorative criminal justice is one of most important outcomes of modern criminal thought, aimed at developing the penal criminal system, Advanced legislation has adopted modern methods of restorative criminal justice, most notably the French legislature, Which approved the system of criminal mediation, criminal settlement, and written confession of the crime.
Therefore, we addressed the manifestations of restorative criminal justice in Libyan legislation, and discussed what it should be like, In keeping with the development of criminal procedures, and in pursuit of a sound criminal policy that aims to reform the accused, without neglecting the rights of the victim, and to and the disruption caused by the crime.
In order to achieve this, I divided the research into two sections. In the first, I dealt with the general provisions of criminal reconciliation in Libyan legislation, and then I addressed proposals for developing restorative criminal justice in the second section, and I concluded the research with a set of results and recommendation.
