Conflict and Inclination between the two generalizations “The Preserved General Heads the Specific General as a Model"
Main Article Content
Abstract
This study dealt with (the conflict and preference between the two generalisations, the preserved general takes precedence over the specific general as a model). In the 16 introduction, I defined conflict, preference, generality, and specificity, linguistically and terminologically. I clarified the meaning of the preserved general. Then I divided the study into four sections. In the first section, I dealt with the methods of rejecting the contradiction between the two generalizations. In it, I explained the approaches taken by the scholars of jurisprudence according to the preferred order chosen from the methodologies of the scholars. I, then, mentioned the reason for ranking this method over other approaches. In the second section, I discussed the importance of the more probable preference and its position among the scholars of jurisprudence, and the formulas contained, in addition to attributing it to those who argued it. The third topic was about how the preserved general takes superiority over the specific general. In this section, I explained the reason for prioritising the preserved general over the specific general, the sayings of the scholars in that, their evidence, and their discussion. I concluded the chapter by mentioning the most correct opinion of it. The fourth topic was the jurisprudential application of giving preference to the preserved general over the specific. In it, mentioned the most famous examples based on this preference. I finished the study with a conclusion in which the most important results and recommendations were mentioned.
